These conditions aim to define the contractual relations between Sarl Moulin du Grand Cèdre - Chemin de la Royère 84160 Cadenet - France and the buyer as well as the conditions applicable to any purchase made through the merchant site "http:// www .bastidedulaval.com , whether the buyer is professional or individual.

The acquisition of a product through this site implies unreserved acceptance by the buyer of these general conditions of sale. Sarl Moulin du Grand Cèdre reserves the power to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

Article 2 - Characteristics of the goods and services offered

The Site is an online sales site for olive products (hereinafter the “Products”) open to any natural or legal person using the Site (the “Customer”).

The Products presented on the Site are each subject to a description (established by the supplier or accessible on the manufacturer's site via a link on the Site) mentioning their essential characteristics. The photographs illustrating, where applicable, the products do not constitute a contractual document. The instructions for using the Product, if it is an essential element, appear on the Site or are sent at the latest upon delivery. The Products comply with the requirements of current French law.

The Customer remains responsible for the terms and consequences of his access to the Site, particularly via the Internet. This access may involve the payment of fees to technical service providers such as Internet access providers, which remain the responsibility of the user. In addition, the Customer must provide and be fully responsible for the equipment necessary to connect to the Site.

The Customer acknowledges having verified that the computer configuration it uses is secure and in working order.

Article 3 - Price

The prices of our products are indicated in Euros, all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs. The prices indicated on each item do not include transport costs. These are indicated in the progress of the site at the step: “Delivery”.

Article 4 - Orders

The Operator strives to guarantee optimal availability of its Products. Product offers are valid while stocks last.

If, despite the Operator's best efforts, a Product proves to be unavailable after the Customer's order, the Operator will inform the Customer by email as soon as possible and the Customer will have the choice between:

  • Delivery of a Product of a quality and price equivalent to that initially ordered, or
  • Reimbursement of the price of the Product ordered no later than thirty (30) days from payment of amounts already paid.

It is agreed that apart from the reimbursement of the price of the unavailable Product, if this option is requested by the Customer, the Operator is not liable for any cancellation compensation, unless the non-performance of the contract is personally attributable to him.

With the exception of any contrary notice appearing in these General Conditions and without prejudice to the right of withdrawal provided for by applicable law, the Customer's orders are firm and final.

When placing an order, the Customer must select the chosen Products, add them to their basket by
indicating the selected Products and the desired quantities. The Customer has the possibility to check the details of his order and its total price, and to return to previous pages to possibly correct the contents of his basket, before validating it.

The Customer undertakes to read the General Conditions of Sale then in force before accepting them and confirming the terms and possible delivery and withdrawal costs prior to payment of their order. Confirmation of the order implies acceptance
of the General Terms and Conditions and forms the contract.

The contractual information relating to the order will be confirmed by e-mail in good time and at the latest at the time of delivery. The Operator strongly advises the Customer to print and/or archive this order confirmation on a reliable and durable medium as proof. A digital invoice can be made available to the Customer at their explicit request.

Any email that will be sent to the Customer in the context of an order will be sent to the email address that the Customer will have communicated to the Operator or the one that he uses to identify himself in his customer area.

The Operator reserves the right not to validate the Customer's order for any legitimate reason, in particular in the event that:

The Operator archives Product sales contracts in accordance with applicable legislation. By making a request to the following address contact@bastidedulaval.com , the Operator will provide the Customer with a copy of the contract subject to the request.

Any modification of the order by the Customer after confirmation of his order is subject to the agreement of the Operator.

The information communicated by the Customer when placing the order (in particular name and delivery address) is binding on the Customer. Thus, the Operator cannot be held liable in any way in the event that an error when placing the order prevents or delays delivery/delivery.

The Customer declares that he has full legal capacity allowing him to commit to these General Conditions.

Registration is open to capable adults and minors provided that they intervene under the supervision of the parent or guardian having parental authority. Under no circumstances is registration authorized on behalf of third parties unless you are validly authorized to represent them (legal entity for example).
Registration is strictly personal to each Client.

In the event of breach by the Customer of any of the provisions hereof, the Operator reserves the right to terminate said Customer's account without notice.

Article 5 - Validation of your order

- Any order appearing on the website www.bastidedulaval.com assumes adherence to these General Conditions. Any order confirmation implies your full and complete acceptance of these general conditions of sale, without exception or reservation.

All the data provided and the recorded confirmation will constitute proof of the transaction.

You declare that you have perfect knowledge of it.

The order confirmation will constitute signature and acceptance of the operations carried out.

A summary of the information in your order and these General Conditions will be communicated to you in PDF format via the email address confirming your order.

Article 6 - Payment

The fact of validating your order implies for you the obligation to pay the price indicated.

When making a purchase, payment is made using the secure payment solution “Shopify Payments”.

Payment for your order is made directly online by credit card (CB, Visa, MasterCard). After confirmation of your payment by our payment provider, your bank account will be debited for the total amount of your order.

We would like to reassure you that all your transactions are secure and comply with the legal provisions in force: they take place within a strict framework of confidentiality and encryption of all your data with our payment provider. We do not at any time have access to your personal data concerning your means of payment, in particular bank cards, and do not store them on our servers.

However, you may wish to save your bank details in your customer account so that they can be reused for your next orders. To do this, simply check the “Save your payment data” box when paying. In this case only, our payment provider (and only it) will keep your data in encrypted form. You can delete the bank card that you have registered either directly in your customer account in the “My payment options” section, or by email by contacting our Customer Service.

This PCI–DSS certified platform guarantees you fast and secure transactions. It allows you to accept payments by CB card (Bank Cards), Visa (French and foreign and Mastercard (French and foreign) and e-Carte Bleue.

The entry of the bank card number and various information is done entirely in the Shopify system and servers. Sarl Moulin du Grand Cèdre has no access to it and no explanation is given to us in the event of refusal of payment. If the bank refuses payment, the order will be automatically canceled.

The card is only debited when the order is shipped. In the event of split deliveries, only the products shipped are debited.

Upon receipt of payment, we will send you your order.

Article 7 - Withdrawal

In accordance with the provisions of article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal without having to justify reasons or to pay a penalty (with the exception of products that deteriorate and perish quickly).

Returns must be made in their original condition and complete (packaging, accessories, instructions) to the following address: Moulin Bastide du Laval, Chemin de la Royère, 84160 Cadenet. Any damage suffered by the product on this occasion may be such as to frustrate the right of withdrawal. If the product has been opened, it cannot be returned.

Return costs are your responsibility.

In the event of exercising the right of withdrawal, the company Sarl Moulin du Grand Cèdre will reimburse the sums paid, upon receipt of the package, within 14 days following notification of your request and via the same means of payment as that used when ordering.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with the provisions of article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:

  • The supply of goods made to the consumer's specifications or clearly personalized.
  • The supply of goods likely to deteriorate or expire quickly.
  • The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.
  • The supply of goods which, after being delivered and by their nature, are inseparably mixed with other items.

Article 8- Availability

Our products are offered as long as they are visible on the site www.bastidedulaval.com and while stocks last. For non-stocked products, our offers are valid subject to availability.

If a product is unavailable after placing your order, we will inform you by email. Your order will be automatically canceled and no bank debit will be made.

Article 9 - Delivery

The countries for which we can organize delivery are: Metropolitan France, Germany, Austria, Belgium, Spain, Italy, Luxembourg, Netherlands, Portugal.

Delivery means the transfer to the Customer of physical possession or control of the Product.

The Operator offers you different delivery or delivery methods depending on the nature of the product or your choice:

Shipping costs are those specified when finalizing the order and are accepted upon validation of the order. They will depend on the delivery option chosen, the amount of the order and the country of delivery.

The Operator undertakes, in accordance with the delivery deadline indicated on the Site for each of the Products, to deliver the Products within a maximum period of thirty (30) days after receipt of the order.

Delivery times are announced in working days on the Site when ordering. These deadlines include the preparation and shipping of the order as well as the deadline provided by the carrier.

The Operator undertakes to ship the Products in accordance with the deadlines announced on each Product sheet and at basket level, provided that payment for the order has not been previously refused.

However, if one or more Products cannot be delivered within the time initially announced, the Operator will send an email informing the Customer of the new delivery date.

The Products will be delivered to the address indicated by the Customer when ordering. It is therefore up to him to check
that this address does not contain any errors. The Operator cannot be held liable if the address provided by the Customer is incorrect, thus preventing or delaying delivery.

Upon delivery, you may be asked to sign a receipt.

No delivery will be made to a PO box.

Upon delivery, it is the Customer's responsibility to check that the Products delivered comply with their order and that the package is sealed and undamaged. If this is not the case, the Customer must indicate this on the delivery slip and take photos of the damage. No complaint about the quantity or condition of the Product will be accepted if the complaint has not been included on the delivery slip.

For delivery to a relay point, the Customer has 14 days to collect their package from the relay point. If, however, the Customer does not pick up his package within the allotted time, the transport costs linked to the new shipment of his order will be entirely his responsibility.

Article 10 - Guarantee

All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects, provided for by articles 1641 et seq. of the Civil Code. In the event of non-conformity of a product sold, duly noted by Bastide du Laval, it may be returned, exchanged or refunded to the exclusion of any compensation or damages.

The products offered comply with current French legislation. Sarl Moulin du Grand Cèdre cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities the possibilities of importing or using the products or services you plan to order.

Article 12 - Applicable law in the event of disputes

These General Conditions are governed, interpreted and applied in accordance with French law.

No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site, whether software, visual or sound.
